Public offer

1. General provisions
1.1. This document is a public offer by “YURTAL” LLC (TIN 312142781, the Provider) to provide virtual server (VPS) services under the YCloud brand. It is made under the public offer provisions of the Civil Code of the Republic of Uzbekistan.
1.2. An individual or legal entity (the Customer) fully and unconditionally accepts this offer when they register in the app.ycloud.uz panel and top up their balance for the first time.
1.3. The Acceptable use policy and the Privacy policy form an integral part of this offer.
2. Definitions
- Service — renting virtual server (VPS) resources to the Customer.
- Panel — the customer account at app.ycloud.uz.
- Balance — the Customer’s prepaid account in the panel, kept in Uzbek so’m.
- Billing period — one month, counted separately for each server.
- Plan — a server’s resources (vCPU, RAM, disk) and monthly price.
3. Subject
3.1. The Provider gives the Customer a virtual server on the selected plan and lets them manage it in the panel (start, stop, reinstall, password reset).
3.2. Servers run on the infrastructure of Contabo GmbH (Germany). The Provider acts as a reseller of Contabo GmbH services and is itself responsible to the Customer for the Service.
3.3. The Customer manages the software and data on the server. The Provider does not back up data stored on servers.
4. Prices and payment
4.1. Plan prices are shown in so’m on the website and in the panel. They are based on the Central Bank of Uzbekistan exchange rate and may change with it. A new price applies from the next billing period.
4.2. The Service is prepaid. The Customer tops up the balance via Click or Payme; the minimum amount is 1,000 so’m. Card details are processed by the payment system and are never passed to the Provider.
4.3. The first billing period is charged to the balance when the server is ordered. There is no setup fee.
5. Renewal, suspension and cancellation
5.1. Five days before a billing period ends, the next month is charged to the balance automatically. If the balance is insufficient, the Customer is notified in the panel and, if connected, in Telegram.
5.2. If payment has still not been made with 2 days left in the period, the server is suspended. Topping up within this window restarts the server automatically.
5.3. If payment has still not been made with 1 day left, the server is cancelled and scheduled for deletion. Deleted servers and their data cannot be restored.
5.4. The Customer may cancel a server in the panel at any time. The amount charged for the current billing period is not refunded.
6. Refunds
6.1. If a server cannot be created for technical reasons, the amount charged is automatically returned to the Customer’s balance.
6.2. Balance funds are intended for paying for services. Except where required by law, they are not refunded in cash or to a card. Refund requests are handled via the contacts in section 10.
7. Obligations
7.1. The Provider delivers the Service according to the plan, notifies the Customer about due payments and server status, and responds to Customer requests.
7.2. The Customer provides accurate registration details, follows the Acceptable use policy, keeps passwords and access credentials secret, and keeps their own backups of important data.
8. Liability
8.1. The Provider’s liability is limited to the amount the Customer paid for the affected server in the current billing period.
8.2. The Provider is not liable for loss of Customer data, actions of third parties, data center or network failures beyond its control, or force majeure.
9. Violations
If the Acceptable use policy is violated, the Provider may stop the server immediately and without notice. Server data is kept for up to 14 days and then deleted. Payment for the current billing period is not refunded in this case.
10. Disputes, changes and company details
10.1. Disputes are settled by negotiation or, failing that, in court under the laws of the Republic of Uzbekistan.
10.2. The Provider may amend this offer. A new version takes effect when published on the website. Continued use of the Service means acceptance of the new version.
